By accessing and using XpertVex services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and XpertVex. By clicking 'I Accept' during registration or credit purchase, you confirm your acceptance of these terms.
XpertVex provides AI-powered startup validation services, including market research, competitor analysis, consumer insights, and market trend forecasting. Our platform uses advanced artificial intelligence (Google Gemini AI) to analyze business ideas and provide data-driven recommendations. Services are provided through a credit-based system with Pro ($49/month) and Enterprise ($199/month) subscription plans. Each credit allows you to perform one comprehensive startup evaluation.
To access our services, you must create an account and provide accurate, complete information including your name, email address, and password. You must be at least 18 years old to use XpertVex. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@xpertvex.com of any unauthorized use of your account or security breach.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our platform. Prohibited activities include but are not limited to: attempting to gain unauthorized access, transmitting malicious code, violating intellectual property rights, using the service to compete directly with XpertVex, abusing the credit system, submitting false or fraudulent business ideas for analysis, or using our AI-generated reports for illegal activities.
XpertVex operates on a credit-based system where 1 credit = 1 comprehensive startup evaluation. Credits can be purchased at $5 per credit with packages ranging from 5 to 50+ credits. Pro plan subscribers receive 10 credits/month ($49/month), and Enterprise subscribers receive 50 credits/month ($199/month). Credits expire 12 months after purchase for one-time buyers. Subscription credits reset monthly and do not roll over. Credits are non-transferable and non-refundable except as required by law.
IMPORTANT: XpertVex uses artificial intelligence (Google Gemini AI) to generate startup evaluations, market research, and business recommendations. While our AI is trained on extensive data, its outputs are for informational purposes only and should not be considered as professional business advice, financial advice, or guarantees of success. AI-generated content may contain errors, biases, or outdated information. You are solely responsible for validating any information before making business decisions. XpertVex is not liable for business outcomes based on AI recommendations.
Credit purchases are final and non-refundable except in cases of technical errors on our end or as required by law. Subscription plans can be cancelled at any time through your account settings. Cancellations take effect at the end of the current billing period - you retain access and unused credits until then. No partial refunds are provided for unused subscription credits. If you believe you're entitled to a refund due to service failure or technical issues, contact support@xpertvex.com within 7 days with detailed information.
By submitting business ideas and information to XpertVex, you grant us a license to process, analyze, and store this data to provide our services. We may use anonymized, aggregated data from user submissions to improve our AI algorithms and platform features. Your specific business ideas will not be shared with third parties or used in identifiable form for AI training. All data is encrypted in transit and at rest. Payment Terms and Billing
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan.
All fees are non-refundable except as required by law or as specified in our refund policy.
Payments are processed securely through third-party payment processors.
You authorize us to charge your payment method for all fees incurred.
We may modify subscription fees with 30 days' advance notice.
Continued use after price changes constitutes acceptance of new pricing.
You may cancel your subscription at any time through your account settings.
Access continues until the end of your current billing period.
Intellectual Property Rights
Our Rights
XpertVex and its licensors own all rights, title, and interest in the platform, including all intellectual property rights. This includes our AI algorithms, software, content, trademarks, and proprietary methodologies.
Your Content
You retain ownership of the business ideas and information you submit. However, you grant us a limited license to process and analyze your content to provide our services and generate reports.
Restrictions
You may not copy, modify, distribute, sell, or create derivative works from our platform or content without express written permission.
Disclaimers and Limitations
We strive for 99.9% uptime but cannot guarantee uninterrupted service. We may perform maintenance that temporarily affects availability.
Our liability is limited to the amount you paid for services in the 12 months preceding any claim. We are not liable for consequential damages.
While we strive for accuracy, we cannot guarantee that all data and analysis will be error-free or complete. Users should verify critical information.
Our platform may include content from third parties. We are not responsible for the accuracy or reliability of such content.
Termination and Suspension
User Termination
You may terminate your account at any time by canceling your subscription through your account settings or by contacting our support team.
XpertVex Termination
We may suspend or terminate your account for violations of these terms, non-payment, or if we determine that your use of the service poses a risk to us, other users, or third parties.
Effect of Termination
Upon termination, your right to access the platform ceases immediately. We may retain certain information as required by law or for legitimate business purposes.
Changes to Terms & Contact
We may update these terms from time to time. Material changes will be communicated via email or platform notification at least 30 days in advance.
These terms are governed by the laws of the jurisdiction where XpertVex is incorporated, without regard to conflict of law principles.
Any disputes arising from these terms or your use of XpertVex shall be resolved through binding arbitration rather than in court, except where prohibited by law.
